1. Scope and Purpose of the General Terms and Conditions of the Store

These Terms and Conditions of Use regulate the terms and conditions under which the online store service "Potier Studio" will be provided. This document defines the rights and obligations of all parties involved in the commercialization process (online purchase and sale) of the products available on the website, between the Customer (hereinafter referred to as the User) and the Seller (hereinafter referred to as "Potier Studio").
The online store website, www.potierstudio.com (hereinafter referred to as "website" or "online store"), is an online retail/e-commerce site developed and operated by Inês do Vale Hipólito Pombo, based in Arruda dos Vinhos, Lisbon, Portugal, hereinafter referred to as "Potier Studio".
The service provided consists of making available, through the website www.potierstudio.com, access to an online store that, in addition to providing information about a set of products and/or services, allows the User to electronically order the products advertised therein, under the terms and conditions described here.

Orders must be placed by Users, whether individual or collective, who declare themselves to be of legal age and legally capable of doing so (individuals under the legal age must have authorization from their representatives). For any purchase made on this site, it is considered that the User has read and accepted these Terms and Conditions of Use and General Sales Conditions, as well as the Privacy Policies. This document will always be available online at www.potierstudio.com and can be consulted freely and at any time, even without being registered on the website.
"Potier Studio" reserves the right to modify these general terms and conditions of sale at any time.

The elements and information transmitted by the User will have full legal effect, and the User acknowledges the electronic purchases, not being able to claim the lack of a signature for non-compliance with the obligations assumed.

2. Obligations and Responsibilities of "Potier Studio"
2.1 "Potier Studio" commits to:
a) Ensuring the information provided is free from typographical errors, and promptly correcting any such errors when they occur;
b) Shipping all ordered products unless out of stock (see items d), e), and f) of section 2);
c) Updating prices and notifying the User of out-of-stock items as soon as possible via the website, email, or phone contact;
d) If a product is unavailable after the order has been placed, notifying the User via email or phone. At this point, the User will be offered the possibility of canceling the order with a refund (item e) of section 2) if payment has already been made or replacing the product (item f) of section 2);
e) Refunding the User the amount paid for unavailable items if they cannot be replaced by a similar product (item e, section 2);
f) Replacing an unavailable product with a similar one. If this is not possible, the refund described in item e) will apply;
g) Notifying the User of any errors resulting from incorrect pricing on the website and allowing the User to either cancel or modify the order, or proceed with the correct price, with no right to acquire the product at the wrong price.
i) Ensuring the confidentiality of all data provided by Users.

2.2 "Potier Studio" has appropriate security levels; however, it is not responsible for any damage suffered by the User and/or third parties due to delays, interruptions, errors, or suspensions of communications arising from factors outside its control, including deficiencies or failures caused by the communication network or services provided by third parties, the computer system, modems, connection software, or any computer viruses or issues resulting from the download of files infected with viruses or other properties that may affect the User's equipment.

2.3 If access to the website is unavailable for any reason, "Potier Studio" will not be responsible for any damages. In this case, the User may place an order using alternative contact methods: social media, phone, or email.

2.4 "Potier Studio" is not responsible for damages resulting from non-performance or defective performance of the service when such non-performance or defective performance is not directly or indirectly attributable to its fault or gross negligence. Specifically, "Potier Studio" is not responsible for:
a) Errors, omissions, or other inaccuracies in the information provided via the service;
b) Damages caused by the User or third parties, including violations of intellectual property rights;
c) Non-performance or defective performance resulting from compliance with judicial or administrative decisions;
d) Non-performance or defective performance resulting from force majeure situations, such as fires, power cuts, explosions, wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods, or other natural disasters or uncontrollable situations that prevent or impair the fulfillment of obligations.

2.5 "Potier Studio" does not guarantee:
a) That delivery times will always be met by the carrier.

3. Obligations of the Consumer
3.1 The User commits to:
a) Providing their personal data through online registration: To proceed with the purchase process, the customer must register, providing certain personal information. All communications with the User will be made to the email or phone number they provided during the registration process.
b) Keeping personal data up to date: Unless indicated otherwise, orders will be shipped to the address provided during registration or an alternative address given by the User during the checkout process. Therefore, the User should ensure their personal data is always up to date or provide accurate delivery details when using an alternative address option.
c) Taking full responsibility for the accuracy and validity of the information provided, with "Potier Studio" disclaiming any responsibility for the incorrect or inadequate use of information.

3.2 If any of the data is incorrect or insufficient, causing a delay or failure in processing the order or delivery, the responsibility lies with the User, and "Potier Studio" disclaims any responsibility. If the User violates any of these obligations, "Potier Studio" reserves the right to prevent future purchases, block access to the store, cancel the provision of any other services, and deny future access to any services offered by "Potier Studio."

4. Products and Prices
4.1 The products sold by "Potier Studio" are available on the website.
4.2 The products listed on the website are, in principle, available for sale, unless out of stock.
4.3 In case of stockouts, and if the User has ordered an unavailable product, "Potier Studio" will inform the User of the unavailability and apply the provisions of items d), e), and f) of section 2.
4.4 Prices listed on the website are in Euros (€).
4.5 The price presented includes VAT at the standard legal rate in force in mainland Portugal at the time of purchase. VAT presented does not entitle the User to a deduction.
4.6 Prices and product specifications may change at any time without prior notice. "Potier Studio" will not be held responsible for any claims arising from these changes. Except for any errors detected in the pricing, the sale price of a product will be the unit price indicated at the time of purchase registration and confirmed at payment.
4.7 The price listed for each item does not include shipping costs. These costs will be added to the total amount.
4.8 If the User believes a received product is defective, they should send a photo to potier.studio@gmail.com on the day of delivery or the following day for investigation and resolution. Note that all items are handmade and may have small imperfections or differences.

5. Website Navigation
5.1 The User can freely navigate the website even without registering, and by doing so, they are not obligated to make a purchase.

6. Order Cancellation
6.1 An order may be canceled without cost to the User as long as it has not been processed.
6.2 Cancellations or changes to the order must be made by email to potier.studio@gmail.com and/or via phone/social media contact.
6.3 For cancellation, the User should provide the Order Number or Name.

7. Privacy and Protection of Personal Data
7.1 "Potier Studio" guarantees the confidentiality of all data provided by Users.
7.2 The personal data collected during registration is strictly necessary for the User to be recognized, contacted, and to provide personalized service.
7.3 The data will also be used for processing orders and for contacting the User if needed.
7.4 "Potier Studio" recognizes the importance of protecting personal data and has implemented security measures to safeguard them.

7.6 By registering or purchasing online, the User expressly consents to the use of their personal data, address, and purchase/payment information. These data will be stored and processed electronically and may be used for communications that reinforce and personalize product offers, services, promotional campaigns, or order processing. "Potier Studio" guarantees that it does not rent or sell User data to third parties, ensuring that all information is confidential and only used by "Potier Studio," except in situations dictated by legal requirements.

8. Intellectual Property and General Information about the Website
8.1 All content on the website is the property of "Potier Studio" and may not be reproduced, transferred, distributed, or stored without prior written permission. Photos presented for each product may not accurately represent colors, shapes, or details.
8.2 "Potier Studio" is not responsible for the misuse of any product or the consequences that may arise from it.

9. Suspension and Deactivation of the Service
9.1 "Potier Studio" may, at its sole discretion, discontinue the provision of the service or part of it to one or all Users at any time, with
or without prior notice.
9.2 "Potier Studio" also reserves the right to suspend or immediately terminate access to the service in the following cases:
a) If the User does not meet the usage conditions described in section 3 or other terms in the General Conditions;
b) If "Potier Studio" ceases access to the store, with a 15-day prior notice.
9.3 Suspension or termination of the service by "Potier Studio," under the above terms, does not grant the User or third parties the right to compensation or reimbursement. "Potier Studio" will not be responsible for any consequences resulting from suspension, cancellation, or termination of the service.
9.4 In such cases, "Potier Studio" will notify the User in advance so that they can safeguard their order history within 3 (three) business days from the notification.

10. Communications
10.1 Notifications related to the service, including any changes to these General Terms and Conditions, may be sent to the User's email, by SMS, or by phone.
10.2 The User agrees to receive all communications related to the Online Store to the address, phone number, or email provided during the order process.
10.3 At any time, the User can request not to receive such communications or notifications via the Contact Form or by selecting "Do not receive the Newsletter" in each Newsletter.

11. Technical Settings
11.1 "Potier Studio" may alter the service or technical conditions of provision, as well as the respective rules of use, providing a minimum 15-day prior notice to the User.
11.2 The current version of these General Conditions and their annexes is available on the website.
11.3 "Potier Studio" may remotely adjust network settings to optimize navigation or improve connectivity conditions.
11.4 "Potier Studio" may alter the service's technical settings to adapt it to technological developments.
11.5 "Potier Studio" does not guarantee any upgrades or improvements to the service.
